from a legal stand point yes, such as this particular case with TM and Zim. Initial police investigators called it an unnecessary killing. One of the bill’s writers even says the law does not apply to Zim.
At what point does someone legally determine they fear for their life? The statute is so ambiguous. If it wasnt flawed there would be no debate. A ton of those comments in that article repeat the point I made about TM feeling threatened by a big bald guy stalking him at night. Technically Martin was well within his rights to turn and confront.
I think your point is valid, but it also means that Zimmerman had the same right to defend. We have two guys in fear for their lives. Since you can never be certdin of someone’s intent, there is a lot of room in the law. Which brings us back to the whole freedom isn’t free deal. Sometimes, shit happens. While it will always be unfortunate, that doesn’t make it illegal or wrong.
Get a Florida concealed carry permit and when you take the mandatory training, the law is clearly explained as to what constitutes reasonable belief one’s life or the life of another may be in danger. There are specific criteria to be met and in this instance the prosecutor ascertained that they were.

Considering zimmerman displayed, some would say, naiveté in contacting the prosecutor directly without counsel (his lawyers then dropped him)…this same guy carried a gun on a daily basis? Correct me, but if I’m not mistaken I believe gun owners, especially those with CCWs should be well versed in the law.
As mentioned in one of the comments, Zimmerman’s worst enemy is his own judgement, which ultimately got him into this predicament. But being an idiot doesnt allow you to walk away without at least an investigation and a trial.

Interesting side note, Zimmerman’s new attorney was Casey Anthony’s attorney.
The prosecution had more concrete evidence of criminal activity in that case.

Knowing the law, and being able to navigate the murky waters of the legal system are two completely different things.

I find it amazing that it only takes two idiots to cause a national uprising. I’m all for gun ownership and stand your ground laws, but this is crazy. The unfortunate results are that there will be one less wantabe junior gangster not going to prison and one dumbass wantabe cop will be going to prison. The only thing that Zimmerman has going for him is there is no eye witness. Rest assured that he will go to prison for the simple fact that the 911 operator told him not to follow the kid and he did it anyway.
It sickens me how this incident has been turned into a media circus revolving around race issues. All I can say I hope Zimmerman likes black penis, because his future is full of them.
