Got a ticket need advice.

I was pulled over today for supposedly going 45 in a 35 mph zone.
The funny thing is, I go back to see where I was radar-ed (where it was written on the ticket) and there is a whopping 45 MPH speed limit sign right there.
I do know that before the sign it is 35 mph, but I know I was only doing 30 before the sign. Also the cop pulled out a parking lot 300 feet AFTER the speed limit sign.

It lists that mobile radar was used. Also, the officer didn’t even pull me over till a whole mile and another street later.

Last thing I need is a speeding ticket conviction right now. I am going to take some pictures of the speed limit sign to take to court.

I am thinking about hiring an attorney, but still not sure what too do.
What do you guys recommend?

Bring pictures of the sign and a map of where you were supposedly speeding into court. Mark on the map where the 45 zone starts, where the cop got you on radar and where he finally pulled you over. Good luck.

Or you could sell the Teg to a relative or friend to keep ($1 title transfer), get a job in China, and then fail to appear. When they ask, “where are you?” just tell them “China.”

don’t laugh, I get paid close to $2000 per month and I pay 20 percent taxes.

I don’t drive because the traffic in Beijing sucks balls, and I don’t pay gas or insurance either.

reading your story, it probably doesnt seem like the cop would win if you had proof of all that.

besides, if he doesnt show up, you win and you pay nothing. so whats the worst that can happen?

sounds like a pretty straight forward win, even if the cop said that you were speeding before the sign, him being after the sign, theres quite a bit of grey area as there is usually a warning sign of where the speed limit area is going to change, meaning an acceleration or deceleration period.

Even if they say there wasn’t that sign, and that you were speeding before, just fight the fact that he pulled you over on a different spot and there is no proof that you were on that street, just use technicalitys I’ve done it, its pretty easy…

Though, Im in canada and our speeding fines are much more than yours lol… if I was going 10mph over it would be almost $250-300 ticket

The fact that it says mobile radar was used dont really help the officer’s case a whole lot. To be honest I doubt he could of even got an accurate speed reading in the first place.

I think they might try to say I was speeding before the 45 mph sign, which I was not. I dont even know a good defense for that.

just goto court and fight the ticket theyl prob drop the ticket all together or lower it dwn to like traveling fast or something lower than speeding if ur lucky they will make u do a donation and that doesnt go on ur record. ive gone to court to many times ive gota cdl n i was shitin bricks cuz i got a wreckless driving ticket and i went to court and i have to b on probation for 6 months on a accelerated rehabilitation program lol but owell atleast the tickets not onma record best bet is just goto court

Ill gather as much evidence as I can and tell you what happens when it does.
Fuckin court is not until Febuary though.

subpoena the maintenance records for the radar. they are supposed to be inspected once every year to insure accuracy. 99% of them aren’t.

Sounds like you have a fighting chance & won’t need it but like he said, here you can make a “charitable donation” to the court or a charity and they’ll nolle the case. Case/charges are dropped, doesn’t go on dmv records and won’t mess with your insurance… just something to think about.

With a map/pictures though, there’s a good chance you can prove the cop was in the wrong. good luck

Second, it doesn’t matter where the cops pull you over as long as he pulled you over.

He probably followed, radioed dispatch and gave all the info on your car then pulled you over or he was probably “Pacing You” to gauge how fast you are going.

Third, I doubt you would win in court against a radar gun since they are more accurate now with the laser guided ones. And if the cop showed up in court the judge will give him more credability just for being a cop.

cop 9/10 times wnt show especialy for a lil traffic ticket

when i was young and dumb i got pulled over for accsesive speeding,recless driving,carless drive and street racing on highways. i fought it and when i went to court the cop did not show up cause they just had a big drug bust about 30mins prior to my court time. i felt like the luckest person in the world. so instead of paying 900 dollars in fines and loosing my licences for 1 year and 7 months i left the court room with nothing.
after that i never even think about racing on the streets or even speeding like crazy. lesson learned haha

read again. he was going 30 in the 35 zone and 45 in the 45 zone. the cop being 300 feet away clearly couldnt tell the exact distance of the OP compared to the 45mph sign so sounds like a pretty easy win.

I’ve said that before when I’ve gotten pulled over. “I was only going blah blah blah”, when I was actually speeding. But then again I was not there to say otherwise.

Also a radar gun can track you for miles not just 300 feet, so you may have slowed down by the time you got to the posted speed sign but you may have been speeding earlier.

You can fight it and hope the cop doesn’t show up, pay the fine and go to traffic school or just pay the fine and be done with it.

I agree. Go to court - the odds are in your favour to win or at least get a lessor fine. It worked for me when I was 19 and charged with careless driving in 1979. (in my '71 Corolla :slight_smile:

Yeah, I am on probation in another county though.
I really hope I dont get a conviction because it might affect that.

That time I was speeding and I had a clean record and I got 1 year probation and it vanishes if I be good.

they call it a deferral. i know in washington, you are allowed one every seven years. if its been longer than one years since you got it, then you have nothing to worry about. i don’t think they go by the date that the ticket was written, they go by whatever date you are found guilty, if you are. and lets hope you aren’t.

so if you were pulled over during the one year probation period, but you court date wasn’t until after it was over, then the other ticket should be long gone. however if the court date is during the probation period, and you are found guilty, then both tickets go on your record.
